Coinbase’s FOIA Reading Room

Coinbase has used the Freedom of Information Act (FOIA) to uncover regulatory actions targeting the crypto industry behind closed doors. This webpage includes the documents Coinbase received from agencies in response to these FOIA requests, which History Associates Inc., a third-party FOIA expert, filed at Coinbase’s direction. When these FOIA requests faced resistance, such as broad denials and excessive redactions, Coinbase directed History Associates Inc. to sue the agencies in federal court for not complying with their FOIA obligations. As a result, this webpage also includes the public court filings from Coinbase’s FOIA litigations against the Federal Deposit Insurance Company (FDIC) – after it pressured banks to pause all crypto-related activity – and the Securities and Exchange Commission (SEC), amid its unsuccessful regulation-by-enforcement campaign against crypto.

MINUTE ORDER. Plaintiff filed this Freedom of Information Act (FOIA) action on June 27, 2024. Dkt. 1 . Defendant filed its Answer on August 7, 2024. Dkt. 13 . Cases filed under FOIA are exempt from the requirements of Federal Rule of Civil Procedure 26(f) and Local Civil Rule 16.3. See LCvR 16.3(b)(10). Accordingly, the Court hereby ORDERS the parties to meet and confer and file a joint status report on or before August 23, 2024. The joint status report should address, among other things, (1) the status of Plaintiff's FOIA request; (2) the anticipated number of documents responsive to Plaintiff's FOIA request; (3) the anticipated date(s) for release of those documents; and (4) whether a motion for a stay under Open America v. Watergate Special Prosecution Force, 547 F.2d 605 (D.C. Cir. 1976), is likely. MINUTE ORDER. Plaintiff filed this Freedom of Information Act (FOIA) action on June 27, 2024. Dkt. 1 . Defendant filed its Answer on August 7, 2024. Dkt. 13 . Cases filed under FOIA are exempt from the requirements of Federal Rule of Civil Procedure 26(f) and Local Civil Rule 16.3. See LCvR 16.3(b)(10). Accordingly, the Court hereby ORDERS the parties to meet and confer and file a joint status report on or before August 23, 2024. The joint status report should address, among other things, (1) the status of Plaintiff's FOIA requests; (2) the anticipated number of documents responsive to Plaintiff's FOIA requests; (3) the anticipated date(s) for release of those documents; and (4) whether a motion for a stay under Open America v. Watergate Special Prosecution Force, 547 F.2d 605 (D.C. Cir. 1976), is likely. As set forth in Section 5(d) of the Court's Standing Order, if the parties agree on a proposed schedule for submitting a further joint status report, they should assume that the Court approves the proposed date unless the Court enters an order to the contrary.
